Herselve publishes editorial content and provides assessments, digital products, programs, events, educational experiences, and other offerings concerning subjects that may include midlife, personal development, relationships, work, money, style, aging, culture, and other aspects of women's lives.

Unless expressly stated otherwise, Herselve's content and offerings are provided for informational, editorial, educational, and self-reflection purposes.

The Site and Herselve's general editorial content may be accessible to a broad audience. Present Me and Herselve's paid personal-development products, programs, and similar offerings are intended for adults age 18 or older.

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or participate in those offerings. By making such a purchase or registering for such an offering, you represent that you meet these requirements.

Present Me is Herselve's proprietary self-reflection assessment. It uses responses provided by the participant together with the Present Me framework, including its five orientations and Eight Energies, to provide a structured view of the position from which the participant is currently engaging with her life.

Present Me Is Not a Personality Test. A Present Me orientation describes a current position. It is not intended to define a person's permanent identity, personality, character, or future. Results may differ as circumstances, priorities, experiences, perspectives, and responses change.

Results Are Interpretive. Present Me results are generated using the responses submitted by the participant and Herselve's methodology. The results provide a framework for reflection. They are not objective determinations about a person and do not constitute guarantees, predictions, diagnoses, or professional conclusions. You remain responsible for deciding what meaning or relevance you assign to your results and for any decisions or actions you take based on them.

Herselve, Present Me, The H. Show, the Herselve Newsletter, programs, events, and other Herselve content and offerings are provided for informational, editorial, educational, and self-reflection purposes. They are not medical care, mental-health care, psychotherapy, psychological testing, diagnosis, treatment, counseling, or healthcare services.

Present Me is not a clinical or diagnostic assessment and is not intended to identify, diagnose, treat, cure, or prevent any medical or mental-health condition.

Herselve content is not a substitute for legal, financial, tax, investment, medical, mental-health, or other licensed professional advice. You should seek appropriately qualified professional assistance when your individual circumstances require it.

Herselve does not guarantee any particular personal, professional, financial, relational, health, business, or other outcome from using or participating in a Herselve product, assessment, program, event, service, or piece of content. Individual experiences vary, and no example or testimonial constitutes a promise or guarantee that you will experience the same result.

Prices and material purchase terms are displayed on the applicable sales or checkout page. By completing a purchase, you agree to pay the amount and any applicable taxes or charges disclosed to you before purchase.

Payments may be processed by third-party payment processors, including Stripe. Herselve does not directly store complete payment-card information. You represent that you are authorized to use the payment method submitted for a purchase.

Present Me is a digital product. After completion of the assessment, results may be displayed electronically and may also be delivered or made accessible by email or another digital method. You are responsible for providing accurate contact information and maintaining access to the email address used for your purchase.

If you purchase a product but cannot access it because of a technical issue, contact hello@herselve.com.

Unless otherwise stated on the applicable sales or checkout page, digital products that provide immediate access to proprietary materials, assessments, personalized results, recordings, downloads, or similar digital content are generally non-refundable once access has been provided.

If you are incorrectly charged or experience a verified technical issue that Herselve cannot reasonably resolve, contact hello@herselve.com. Nothing in these Terms eliminates any refund or consumer right that cannot lawfully be waived.

The Site and Herselve's original content, products, and materials are owned by or licensed to Herselve and are protected by applicable copyright, trademark, and other intellectual-property laws. Protected materials include, without limitation:

• the Herselve name, branding, logos, and visual identity
• articles, newsletters, commentary, written materials, and editorial content
• The H. Show episodes and related audio, video, transcripts, and materials
• assessments, questions, prompts, reports, downloads, and educational materials
• Present Me and its methodology, orientation materials, and result materials
• the Present Me five-orientation framework and the Eight Energies framework
• program, event, workshop, and educational materials

Nothing in these Terms transfers ownership of Herselve intellectual property to you.

Subject to these Terms, Herselve grants you a limited, revocable, non-exclusive, non-transferable license to access and use Herselve products and materials you lawfully obtain solely for your personal, non-commercial use unless Herselve expressly authorizes another use in writing.

Except as expressly authorized by Herselve or permitted by applicable law, you may not reproduce, republish, distribute, sell, license, publicly display, commercially exploit, or create unauthorized derivative products from Herselve's protected materials. You may not purchase or access Herselve materials for the purpose of copying, recreating, or commercially exploiting Herselve's proprietary products or methodologies.

Present Me represents substantial original creative and developmental work. Except as expressly permitted, you may not:

• reproduce or distribute Present Me assessment questions or result materials
• sell, sublicense, or commercially exploit Present Me content
• use Present Me materials to create a substantially similar assessment or commercial product
• represent Herselve's original frameworks or methodology as your own

Except where applicable law provides otherwise, Herselve's non-public, paid, or proprietary materials may not be systematically scraped, ingested, or used without Herselve's prior written permission to train, fine-tune, develop, or create an artificial-intelligence model, machine-learning system, dataset, or competing commercial product. This includes Present Me assessment questions, orientation materials, Eight Energies materials, result reports, and evaluation methodology.

Herselve publishes commentary, conversations, interviews, reporting, recommendations, educational material, opinion, and other editorial content. Some content reflects Herselve's editorial perspective. The views expressed by a guest or contributor do not necessarily represent Herselve's views. Information can become outdated over time.

Herselve may publish advertising, sponsored content, paid partnerships, affiliate links, product recommendations, or other commercially supported content. Where required by applicable law, Herselve will disclose material commercial relationships in connection with the relevant content.

Participation in a Herselve program or event does not create a therapist-client, physician-patient, attorney-client, financial-adviser, or other licensed professional relationship with Herselve. Specific offerings may have additional terms disclosed during registration.

You may not attempt to gain unauthorized access to systems or restricted content; interfere with Site security or operation; introduce malicious code; impersonate another person; engage in fraudulent transactions; circumvent payment or access controls; violate applicable law; or use Herselve's services to facilitate unauthorized exploitation of Herselve's intellectual property.

Herselve uses and links to third-party websites, platforms, payment processors, and other technologies. Those services operate under their own terms and privacy practices. Herselve is not responsible for their availability, security, content, or conduct.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND HERSELVE'S CONTENT, PRODUCTS, ASSESSMENTS, PROGRAMS, EVENTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." HERSELVE DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HERSELVE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR A HERSELVE PRODUCT, ASSESSMENT, PROGRAM, EVENT, OR SERVICE.

HERSELVE'S AGGREGATE LIABILITY FOR A PAID PRODUCT OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

These Terms and disputes arising from or relating to them will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Before commencing a legal proceeding against Herselve, you agree to make a reasonable good-faith effort to resolve the dispute informally by contacting hello@herselve.com. This requirement does not prevent either party from seeking urgent injunctive or equitable relief where appropriate.

Herselve may update these Terms to reflect changes in its business, products, services, technology, or legal obligations. The "Last Updated" date identifies the latest version. Changes will apply prospectively unless applicable law permits otherwise.

If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will continue in effect. Herselve's failure to enforce a provision does not waive its right to enforce it later. These Terms, the Privacy Policy, and any additional product-specific terms constitute the full agreement between you and Herselve concerning the matters they cover.
